By accepting and using this Card, you agree to be bound by the terms and conditions contained in this Cardholder Agreement. Customer Service refers to the support provided to you by us in using the Card, and may be contacted at by telephone, or at the mailing address location listed at the conclusion of this Cardholder Agreement. Card Carrier is the document onto which your Card is adhered and containing your Account and routing numbers. The Card will remain the property of MetaBank and must be surrendered upon demand.

The Card is nontransferable, and it may be canceled, repossessed, or revoked at any time without prior notice subject to applicable law. If you obtain your funds or make a purchase in a currency or country other than the currency on your card or make a purchase from a merchant using a bank that uses currency other than the currency or country in which your Card was issued , the amount deducted from your funds will be converted by the network or card association that processes the transaction into an amount in the currency of your Card.

The Card is a prepaid card. The Card allows you to access funds loaded to your Card Account by you or on your behalf. Your Card Account does not constitute a checking or savings account and is not connected in any way to any other account you may have.

The Card is not a gift card, nor is it intended to be used for gifting purposes. The Card is not a credit card. You will not receive any interest on the funds in your Card Account. The funds in your Card Account will be FDIC insured up to the amount provided by law, provided your Card is registered.

Your funds will never expire, regardless of the expiration date on the front of your Card. To help the federal government fight the funding of terrorism and money laundering activities, the USA PATRIOT Act requires all financial institutions and their third parties to obtain, verify, and record information that identifies each person who opens a Card Account.

What this means for you: When you open a Card account, we will ask for your name, street address, date of birth, and other information that will allow us to identify you. We may limit your ability to use your Card or certain Card features until we have been able to successfully verify your identity.

If you have questions about this requirement, please call Customer Service. Other than the event where an additional card is required, you may not permit another person to have access to your Card or Card number. If you do provide access to your Card or Card number, you are liable for all transaction made with the Card or Card number by those persons. You must notify us to revoke permission for any person you previously authorized to use Card information or have access to your account.

You are responsible for all transactions and fees incurred by you or any other person you have authorized. You will receive a Personalized Identification Number "PIN" by calling to activate your Card and establish a PIN.

You may use your Card at any Point-of-Sale POS device which requires entry of a PIN, that bears the PLUS, INTERLINK or STAR symbols. You should not write or keep your PIN with your Card. Never share your PIN with anyone and do not enter your PIN into any terminal that appears to be modified or suspicious.

In some cases arrangements have been made that may allow you to load additional funds to your Account though the methods described below. There may be a limit on the number of times you may add Retail Loads to your Card, the maximum dollar amount loaded, or other limits on Retail Loads. See Fee and Transaction Limits Schedule for details. You agree to present the Card and meet identification requirements to complete load transactions as may be required from time to time.

See the Transaction Limits Schedule for information regarding limits on loads and other transactions. The owner or operator of the POS terminal at the Retail Load Agent where you complete a Retail Load may charge a fee for loading value to your Account which is in addition to any applicable load fee as indicated on the Fee Schedule , and, together with ATM owners or operators, as well as banks, check cashers and other service providers, may impose different minimum and maximum and limits than those set forth in the Transaction Limits Schedule.

You may use your Card to: Some of these services may not be available at all terminals. Your Card cannot be redeemed for cash.

You may use your Card to access cash at an ATM. Loads Deposits to your Card Account are not permitted at our ATM terminals. You may not use your Card for any illegal transactions, at casinos, and for any gambling activity.

For security reasons, we may limit the amount or number of transactions you can make with your Card, but in general: An initial stock of Money Network Checks will be provided with your Card. In addition to using your Card, you may choose to access the funds in your Account by completing a Money Network Check.

The IVRU process requires you to enter the number on your Card in order to access your funds with a Money Network Check.

Even if you choose not to use the Card, you will need to keep your Card number in order to use the Money Network Checks. The amount of the Money Network Check you authorize using the IVRU will be electronically debited against your Account immediately. Please note that once you complete a Money Network Check with a transaction number, that Money Network Check is valid for the amount authorized and could be cashed or negotiated by anyone who has possession of the Money Network Check.

If an authorized Money Network Check is not cashed or deposited within days after the date it is authorized, the Money Network Check will be canceled and the funds credited to your Account. You are responsible for all transactions initiated by use of your Card, except as otherwise set forth herein.

If you do not have enough funds available in your Card Account, you can instruct the merchant to charge a part of the purchase to the Card and pay the remaining amount with cash or another card. Some merchants will only allow you to do a split transaction if you pay the remaining amount in cash.

If you have told us in advance to make regular payments out of your Card Account, you can stop any of these payments by contacting Customer Service in time for us to receive your request 3 business days or more before the payment is scheduled to be made. If you call, we may also require you to put your request in writing and get it to us within 14 days after your call.

If these regular payments may vary in amount, the person you are going to pay will tell you, 10 days before each payment, when it will be made and how much it will be. You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment, or when the amount would fall outside certain limits that you set.

If you order us to stop one of these payments 3 business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages. You must write to Customer Service when you change your address. You agree that any communications sent to you at your last address on record with us will be deemed to have been received by you.

For purposes of these disclosures our business days are Monday through Friday 8: Federal and Bank holidays are not included.

If you are entitled to a refund for any reason for goods or services obtained with your Card, you agree to accept credits to your Card Account for such refunds. The amounts credited to your Card Account for refunds may not be available for up to five 5 days from the date the refund transaction occurs.

You should get a receipt at the time you make a transaction or obtain cash using your Card. You agree to retain your receipt to verify your transactions. You can get a receipt at the time you make any transfer from your Card Account using one of our ATM terminals. You may obtain information about the amount of money you have remaining in your Card Account by calling Customer Service.

This information, along with a day history of account transactions, is also available on-line at account. You also have the right to obtain a sixty 60 day written history of account transactions by contacting Customer Service.

We may disclose information to third parties about your Card Account or the transactions you make:. If we do not complete a transaction to or from your Card Account on time or in the correct amount according to our Cardholder Agreement with you, we will be liable for your losses and damages proximately caused by us.

However, there are some exceptions. We will not be liable, for instance:. This Cardholder Agreement will be governed by the law of the State of South Dakota except to the extent governed by federal law. We may amend or change the terms of this Cardholder Agreement at any time without prior notice to you except as required by applicable law.

This Arbitration Provision sets forth the circumstances and procedures under which claims as defined below may be arbitrated instead of litigated in court.

We may require you to provide a written statement regarding claims of unauthorized transactions.
